Subdivision Exemption Fee Increases
Missoula County commissioners approved the increase in land use fees for subdivision exemption applications at their public meeting on Sept. 28, 2023.
Missoula County proposed to increase land use fees for subdivision exemption applications from $200 to $400. This was the first time this fee had been raised in 20 years. Without this fee increase, local taxpayers would cover the costs of this review.
Missoula County charges land use fees to help cover the costs of review for a variety of land use applications, including subdivision exemption applications. Subdivision exemption applications are completed for divisions of land such as family transfers, boundary line relocations, creation of cemetery lots and court-ordered divisions, which are not subject to full subdivision review. Missoula County staff review these subdivision exemption applications to determine that the applicant is not evading subdivision review. Missoula County typically receives 15 to 20 of these applications each year.
Since 2003, Montana law has allowed the County to assess $200 for the review of each subdivision exemption application, which has been part of the County’s land use fee schedule. With the passage of House Bill 874 in the 2023 legislature, the County can now charge $400 per subdivision exemption application.
